WhalePod Browser is a desktop application designed for social media content creators and operators, providing multi-platform account management, automated and scheduled publishing, OAuth-based connections to third-party platforms, and unified team workflows.

2. Account Registration

• A registered account is required to access the full features of the Software.
• You must provide accurate and complete registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• Accounts are non-transferable and may not be shared, rented, or sold to others.
• You are responsible for all activity that occurs under your account.

3. Third-Party Platform Integrations

When connecting third-party platforms through WhalePod Browser, you must comply with each platform's terms of service. You authorize us to perform publishing actions on your behalf, but you remain responsible for the content you publish. You may revoke authorization for connected platforms at any time within the Software.

4. Acceptable Use

• Do not publish content that violates applicable laws or connected platform terms.
• Do not infringe intellectual property, portrait rights, privacy rights, or reputation rights of any third party.
• Do not distribute spam, conduct fraud, or engage in deceptive marketing practices.
• Do not disrupt, attack, or interfere with any third-party platform.
• Do not reverse engineer, decompile, crack, resell, or redistribute the Software.

5. Payment and Refunds

• The Software may offer a free trial and paid subscription plans. Current pricing is listed on our website.
• Subscription fees are billed in advance per billing cycle and renew unless cancelled.
• You may cancel renewal through your account settings where available.
• Refunds may be available within 7 days of purchase if a critical feature defect cannot be resolved by our team.
• No refunds are issued after 7 days or for accounts terminated due to policy violations.

6. Intellectual Property

• All intellectual property in the Software, including code, UI design, trademarks, and documentation, is owned by us or our licensors.
• Content you publish through the Software remains your property; we claim no ownership over it.
• You may not copy, modify, or distribute the Software without written permission.

7. Disclaimer of Warranties

• The Software is provided "as is" without warranty of any kind, express or implied.
• We do not guarantee uninterrupted or error-free operation.
• We are not liable for account bans, rate limiting, policy changes, or API changes imposed by third-party platforms.
• We are not liable for service interruptions caused by network failures or force majeure events.
• To the maximum extent permitted by law, our liability for direct damages is limited to your most recent monthly subscription fee.

8. Service Modifications and Termination

• We may modify, suspend, or discontinue the service with reasonable notice where practical.
• We may terminate your account immediately if you violate these Terms.
• After termination, you may request a data export within 30 days where technically feasible.

9. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notification, email, or website notice before taking effect. Continued use of WhalePod Browser constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by applicable law in the jurisdiction where the operating company is registered, without regard to conflict of law rules. Disputes should first be resolved through good-faith negotiation.
